    My uncle died in 2002 leaving a will that stated my mother got all his money and his house and possessions. However, the wording of the will said he leaves her the house absolutely based on the condition that she lives in the house. If she didn't, the house was to be sold and the money divided between me and my sister. She didn't want to live in the house, but did. His will states that the house is hers til she dies or moves out, but then it comes to me. She has made her own will leaving everything she owns to someone else. I've checked with the land registry and the title, deeds etc are solely in my mother's name with nothing listed as being left in trust to me (she and my uncles solicitors are the executors and trustees of his will). Who will get the house when she passes? Her named beneficiary in her will, or myself named in my uncles will? Thank you in advance for any advice, gratefully received.

    It’s not her house to gift away.

    You need to have a clause noted on the restrictions at land registry, that will stop whomever her beneficiary is, from inheriting it.

    Or you could have a solicitor write to her to explain/follow your uncles will.
