  • Trust / Will Query in relation to step child

Hi. My mum, sister and I have a Lifetime Property Protection Trust ('LPPT') for my mum's home with all three of us being trustees. My mum's will, when she passes, transfer her estate and the property held in the trust equally to my sister and I.

In the event that I or my sister pre decease my mum, the will states that my share passes to my two children equally. My son is 14 and is my biological child. My daughter (26) is not my biological daughter however I have Parental Responsibility Order for her. granted when she was 10. Her father was not on the birth certificate.

The will states that my share will transfer to "my issue" if I pass before my mum, however I would like to check if my daughter, not being my biological daughter, will prevent her receiving my share if I predecease my mum.

Any help would be appreciated. My mum is happy to amend the will but I would like to know if this is an issue or not.

    PS. My dad is deceased.

    Thanks

    Bob

I think that it would not pass to your non-biological daughter. Short of adoption, she would not be yout issue.
