  • Problems with Probate registry

    All IHT forms were submitted by my (I am the executor and beneficiary) solicitor to the Cardiff office on 28 March 2022. No correspondence was received so we chased on a regular basis. Every time we phone we receive different information and issues flagged. Finally HMRC said that form 421 has been uploaded to the Probate office “sharepoint” system. Probate claim it hasn’t. I have had this verified by HMRC twice. The main problem is that the case has been transferred to the Probate office in Newcastle. Newcastle claim my solicitor didn’t submit an original will. He did and it was sent to him by the original firm who stored the will (they referred to it as an original). We think it hat Cardiff have lost the original will! Probate office not communicating with solicitor. They don’t acknowledge or answer his emails sent to both Cardiff and Newcastle. If he phones he is told that the correspondence hasn’t been uploaded to their case system so can’t help him. Solicitor has submitted a “statement of truth” by email and post. They haven’t acknowledged this. We are at an impasse. I simply don’t know what to do! Is it with submitting a complaint on their online system. Anything else can be done? I would really appreciate some help. Many thanks

    Your solicitor appears to be doing what can be done. The reality is that the court system is in disarray.
