    Good morning! I wonder if someone might kindly aid us in clarifying something. If one was to inherit let’s say 250k and you decide at that time to vary by deed 50k to daughter A and 80k to daughter B (due to more pressing personal circs for B) with 120k remaining of the legacy, could one first, have two separate deeds so neither one sees the other and secondly would we be able to issue later deeds of variation to A and B if we so wished with remaining 120k depending on events for us within the two years. I am just confused as to whether the ‘asset’ (which we are told can only be varied once) is deemed the cash legacy to us in its entirety or just the portion we wish to give at that time if we clearly state a running tally that we wish to vary 50k of total 250k to daughter A and then on deed 2 vary 80k of the remaining 200k… so then any further deed we wrote would be x of 120k remaining to x etc. or if we only get one bite of the cherry and have to say in the one document, of this ‘asset’ of 250k we wish to give A x and B x and that’s it. Hope this makes sense more words than likely required!

    The normal way is for the deed of variation to be done with agreement of all beneficiaries. If there are minors, then they cannot agree. However, the DOV can encompass any changes required but only once as it is a change to the original Will and will be the only change. A solicitor can advise you the best way forward.
