  • Family member has hard copy of will, refuses to engage or give it to the executor!

Hi there! Any help is much appreciated on this forum

Posting on behalf of my mother - she is the executor of her now deceased parents will. Who were British citizens and was then living in the Caribbean post retirement/ where they were originally from.

My cousin when over there for the funeral went through and took a lot of their paperwork; marriage certificate, birth certificates and the hard copy of their will to which my mum is the named executor.

My mum is planning a trip over to the Caribbean to probate the will, but when we called the solicitors they don’t seem to have their own copy as they asked us for ours! And she needs it to apply to the Supreme Court for probate. She’s only got photos of it on her phone.

The cousin is not engaging with us at all and I just want some advice/ clarification on how we can get her to cooperate and give up the will that she ‘stole’

Hi, difficult to say what the rules are in the Caribbean, so it would be best to speak with the Caribbean Solicitor you are in touch with, as they would be able to approach your cousin and obtain the documents. Your mother can instruct them to act on her behalf (if its a Caribbean Will, but if it is an English Will, speak to an English Solicitor who can act on her behalf), and they can deal with the process from there
