  • Solicitor advice needed

    18 years ago we paid to have my mother in law’s house put in a trust recently she as had to go in care we contacted the solicitor we used who said they have no paperwork regarding the trust fortunately we found all the paperwork in mother in law’s house we have a invoice dated mid September 2003 stating it’s for putting the house in trust to the children we then have a receipt dated early October 2003 saying we paid that day we also have papers signed by us a a witness when we presented these to the solicitor they said they looked like the original signed paperwork and we must not have returned them we said we must have and maybe they had copied them as we paid two weeks after invoice by cash so we must have returned we also have a letter saying the solicitor as the deeds which they say they don’t have either we contacted land registry who says there is no trust registered on the property basically we have paid to have the house in trust the solicitor as not registered it and there response is we must not have brought the signed paperwork back where do go from here ?

    First up i would obtain a copy of Land Registry file (cost £3 here https://www.gov.uk/search-property-i...-land-registry)
    Then if you find the info given by LR is correct (don't ask how I know they get it wrong sometimes) you make a formal complaint to the firm of solicitors.

      Been on land registry it as not been done still in mother in law’s name basically we’ve paid them and they’ve not done anything

        Who were appointed as Trustees of the Trust?

        As a Trust exists and payment has been made for that to be registered on the property, ask the original solicitors if they are prepared to register the original Trust now, or face official complaint procedure.

        It is unfortunate that the Trust was not returned to the solicitors to enable them to register thecharge, but non the less, a Trust exists that is legal and it should be registered on the property
