    Hello,
    My Aunt unfortunately died recently. My sister died 2 years ago also. Does the inheritance due to my sister automatically go to her brother (my a Aunts nephew)?
    My sister had a long term partner...never married though.

    We live in Scotland.

      Ahh.ok..if the will says if either nice or nephew dies, the amount bequeethed (spell) to deceased party will go to the remaining living party....otherwise the money gets absorbed into the estate and allocated to the offspring of the deceased aunt?

        Rather than second guessing the wording of the will, you need to get the actual wording, not all wills are the same.

        If probate was granted you can obtain a copy of the will here. https://probatesearch.service.gov.uk/#wills

            The probate search website won't help because it does not contain wills in Scotland.

            If the will contains a legacy for your late sister, then if the will does not have provision for her earlier death, and if your sister had no children, then the legacy will pass into the rules of intestacy.

            Application of intestacy rules depends on aunt's circumstances.

              The quoted probate site covers the whole of the United Kingdom of which the last time I looked includes Scotland.

                Gov.uk site states that probate search applies to the UK, but it doesn't . It doesn't extend to Scotland.

                Though I am happy to be corrected if anyone can find a will from Scotland on the probate search website
