  • Bonis Non

Hi, I'm needing advice. My Mother died at the beginning of 2020 and I am executor to her will, (probate was taken and granted). On administraring her estate, I found shares still in my Father's name, and my mother was executor. I'm now having a nightmare trying to change the shares into my name, depending on who I speak to I have repeatedly been told different things. I have successfully obtained a replacement share certificate, however now I've been told I can't deal with it unless I obtain a Bonis Non or fill in a Small Estate Form, has the broker got this correct, on my searches, the change of representative still exists.

My understanding is that as your late mother failed to complete administration of your late father's estate, but appointed you as executor to her estate you do not apply for a grant grant de bonis non administratis (nor small estates form) as you automatically have responsibility for completing the probate of your father's estate.
refer sec 7 of Administration of Estates Act 1925 (https://www.legislation.gov.uk/ukpga...6/23/section/7 )
