  • Are the Executors dragging their feet or incompetent

    My mother in law died in March 21. I was originally her executor but I decided it would be too difficult so I was removed as Executor.
    2 other relatives obtained probate in April 21.
    Her flat sale was completed in May 21. The total on the probate form was less than 75k.
    I suspect there were Care Home bills but as the executors were also her Deputies prior to her death, I do not know how much.
    i have obtained a copy of the will from the Gov Probate Service which confirms I am a residual beneficiary.
    The executors have never contacted me or any other beneficiary of the will.
    I have written by email asking them for an account of the estate - no response.
    What should I do next? The other beneficiaries were all left specific sums and some of them could really do with the money.

    Care home fees can be anything from £750-£1200 a week depending on what part of the country.

      Condolences on your loss

      No sensible executor will distribute the estate until after 6 months from receiving the grant of probate, so you have just reached the end of that period.

      It would have been sensible of the executors to have kept you informed of progress, but it is not a legal requirement.

      I would suggest giving them another 4 weeks before chasing further

        Yes that is sensible. However, the Executors have been her Deputies in the Court of Protection for the past two years so they already had full knowledge of her situation and financials.

          Yes. Her funds have been eroded away for the past 4 years.
