Hy.Im away few days or so cant have internet. From my researcghing, the property, as it is left in Trust by dad to son, and he still has to live in it, and potentially up to 52 weeks in care home is classed as temporary, then have I got it right that I do not need to put the home as part of dads capital for financial assesment.. Im trying to get things sorted by 17th and hoping to explain dad at weekend, understand and sign POA, if not then its game over.
Will, What if person inherits inst fit to look after themselves or home

Your father has already made the property over to a trust for the benefit of your brother, whilst retaining the right to live in it himself?
So the house is not part of your father's capital, but be aware the local authority can challenge the reason and possibly claim creation of the trust was deliberate deprivation of assets.
It will depend on the circumstances.
