  • Disputing a Will from abroad

    Hi - Whilst my parents are very much still around and hopefully will be for many years to come, i still would like to prepare myself for a possible future problem..... My parents Will is held with a solicitor and equally split between myself and my brother who i don't get on with so well. I believe my brother will be the legal executor of the Will because i live abroad (Not in the EU) and he is local. Furthermore, the majority of the assets which will be split between us will be housing related as my parents have two properties, both fully paid for BUT my brother lives in one of them renting from my parents. I can forsee a time when the Will is in probate that i have difficulty recovering my rightful portion because he would be the legal executor, he lives in one of the properties (possession is 9/10ths), I am not local etc....... How would i handle such a situation? I know he is required to act in accordance with the Will or i could take him to court and he would be liable for legal fees etc, but how long would that take? What legal advice could any of you give. Thanks
