  • Continuation of Executors duties after estate has been finalised

If an estate has been finalised and distributed and then a beneficiary starts a PPI claim on behalf of the deceased, is the Executor obliged to sign the claim forms or the forms relating to a subsequent complaint to the Financial Ombudsman.

    Hi,
The executors duties continue after distribution particularly if other matters come to light. They are the person able to deal with any potential claim. If a claim is successful then any asset should then be distributed according to the Will and also letting HMRC know so any tax can also be dealt with, if applicable.
In relation to the ombudsman it depends what the issue is I would imagine.
I am a qualified solicitor and am happy to try and assist informally, where needed.

If in doubt you should always seek professional face to face legal advice.
