No - A section 78 request is for consumer credit agreements, i.e. loans, credit cards etc and not for Mobile Phone contracts. You should write tot hem asking for a balance statement, whilst maintaining the fact that you do not acknowledge the debt - Or you could simply ignore the letter as its likely just a phinishing exercise by them to see if they can rope you into responding.

If you can post up a copy of the letter or what the content of the letter was, minus personal details and reference numbers etc. Then we can give you a more precise answer on what to do or how to respond.

When was the last payment made? If it was over 6 years ago, any outstanding amount would be statute barred. :thumb:

Mobile contracts don't fall under the CCA so a s.78 request wouldn't apply.

          Hi seduraed,

Thanks for making me aware of this.

If you and your wife would like me to get this looked into, could you ask her to email me with her details via the Contact us form here and quote the code WRT135 - FAO Lee in the subject line?

Once sent she'll receive an automated reply with a reference number. To make sure it reaches me, could you update the thread with this and I'll get back to her as soon as I can?

          Kind regards,

          Lee
