  • Compensation after conviction

    Hello, thanks for any advice.
    My child was attacked and their nose broken. The police were involved from the outset and it went to court and the attacker pled guilty and my child was not required to attend.
    We received a letter to say the convicted was ordered to pay £400 compensation.
    This seemed low considering the nature of the attack and subsequent journeys to hospital for manipulation etc.
    I have never been particularly interested in compensation but as this is my child and I
    know what they went (and continue to go) through I think they deserve more.
    is there anything I should do? (Scottish system).

    The court never asked for a doctor’s report so they don’t know the extent of the injury.

    I do not know the Scottish system, but expect that you can bring a claim in the civil court. I would expect that the £400 will be credited towards any further compensation.

      In the English magistrates court system the amount which can be given will depend on income of the offender. Often costs and victim surcharge are waived to give more compensation. It is often paid at the rate of £5 a week if the offender is on benefits.
