  • Grant of Confirmation

    Hi there,

I have a situation where my late father bought out his business partner in the early 90s, the sale included a couple of commercial properties, however it transpires that his business partner's name were never removed form the title deeds. There are two different situations
    • One property they owned as business partners
    • In the other they were assigned to take over a 999 year lease which was done in their own names
We have a letter from his ex partner confirming that my father bought his 50% share of the partnership and that the sale included all of the commercial properties, is that sufficient for me to fill out my late father's C1 showing him having full ownership of these properties?

    Thanks Baz

The C1 process is administrative, the court checks appropriateness of entries but has no check on whether ownership is accurate. Accuracy is the responsibility of the applicant.

If the issued Grant of Confirmation contains an inaccuracy, this can be changed by submitting a corrective inventory.

So, the need to prove ownership or entitlement sits outside of the Confirmation process.

But looking at your previous posts - was your father domiciled in England? If so, the usual process would be to obtain a grant of probate there.
