  • Duty of care?

    Whilst boarding a ferry in Aberdeen to sail to Lerwick the crewmember in charge of loading us closed our wing mirrors, (we cannot see with a rear mirror) so blinding us. Instructed clearly to "go hard right" I did and my rear passenger side was caught on bolts on the port side of the vessel badly damaging my motor home. I have contacted my insurer and they say I have to claim against my policy as I am at fault??

    Any advice please?

    This would be a matter of Scottish law, I think. You will need to wait for someone with Scots law knowledge to come along.
