  • SSPCA took my dogs

    Hello,
    I have a question regarding SSPCA taking my dogs away before I start looking for a solicitor locally, first of all I didn’t get a copy of a warranty, no appeal form too (their website states I should). Anyway, my pup broke his leg (canine fracture), nothing serious in theory but ended as my the worst nightmare, I took the dog to the vet as I thought he broke his leg, emergency appointment, my local vet clinic said come back after a week as we are busy ?!? (once again, emergency), anyway chased them to get it sooner, Xray done bones fractured, not crushed or open fracture but they gave me two options, cut the leg off or put the dog down, obviously none were an option, told them that I am taking dog away elsewhere, they said we need to know where are you taking your dog, otherwise we get SSPCA involved, of course they did (next day SSPCA came, I wish emergency could have been booked for next day), I managed to find orthopaedic with some good reviews on the internet and they said “we can save his leg”, operation done, in theory all fine, never had a chance to talk to the doctor afterwards, didn’t see Xray before and after but since day number 1 dog was unable to use his leg fully, I do understand recovery will take couple of weeks, she mentioned that leg might not be straight and it wasn’t but the leg was operational, dog was happy, at least I didn’t see any bad reactions. I went after a couple of weeks to see my local vet (elsewhere than usual) and they were not impressed with his leg, they said he probably broke it again but we don’t feel any fracture, take him back, it was night time, I knew no doctors would be there but they said it will cost me four digit amount for this, pretty expensive hotel for a dog. I was planning to do it during the week when doctor would be there but before it, SSPCA came, took all my 5 dogs away as they were “neglected”, I wish other dogs to be as well treated as mine are/were. Anyway, next day morning call from SSPCA, your dog needs his leg amputated (he is only 3months), so for the rest of his life he will become disabled, before they took my dogs away I spoke to SSPCA and I told them, there is no way that I will allow to amputate his leg, the operation was expensive, amputation would cost me a small amount of operation but now, I didn’t help my dog which of course I have done everything to save him plus they took my dogs away and probably by now amputated his leg ?!?
    Where do I stand now ? I will do everything to have them back, the dogs are in my opinion in very good condition, well treated (regular vet visits etc.) but I fell like I lost them by trying to save puppy’s leg and it makes me very sad, I let them down. I spent two weeks with the dog, almost 24/7. Maybe the operation didn’t go well, but I cant prove, how ? No xrays before/after. If I would put the dog down then they will be no problem from my point of view but this is not wellbeing and clearly SSPCA is not interested in it. Secondly how do I know they are telling me the truth as “we took him to our specialist”, paper will accept anything, they can say all legs were broken etc., you neglected your dogs and forget about them. Of course ….

    What do I do now ? Will I ever get them back, can I visit the dogs while they were taken away ? Sorry for the long post. Story is not made up, thousands spent and instead of helping the poor boy, lost them all.

    Did they have a warrant ,they should have had.

    there a fake sspca inspectors going around taking dogs so check it was the real people

      Yes, warrant was issued within a day or two from what I have seen. I didn't get a copy by the way. Police was there too.

        I think that realistically it's a case of taking the warrant to a solicitor and getting some advice from them. I am moderately amazed that they got a Sheriff to sign off on a warrant where they've not seen the other dogs in question, so it could well have holes throughout it.

          Local Citizen Advice said that they can take all the animals, not only dogs, simply all of them. I am in Scotland

            No, I know, and I've seen SSPCA working from the enforcement side (I'm an ex trainee Sheriff Officer who has had to serve paperwork re dangerous dogs before) but from your description I'd love to know what their justification was. Although I am aware some of the SSPCA enforcement staff can be somewhat militant.

            Unfortunately as I said, I think it's time to solicitor up and see what they can do. This isn't something I'd want to try and negotiate as a layman.
