Euro Car Parks/Debt Recovery Plus

Hi, we have a leased car that was the subject of a ‘Notice to Hirer’ from Euro Car Parks. This was in Scotland and was issued in November. The lease company passed our details to Euro Car Parks. We have ignored to date but today we received the standard Debt Recovery Plus letter demanding £170 accompanied by some scary doomsday scenarios. This recent letter has definitely given someone in the household the jitters! Having read many of your threads, I am sure we should ignore these (we haven’t responded at all to either Euro Car Parks or DRP) however, I am concerned they then go back to our lease company. They had stated originally that they would settle any fine imposed should we not do so. I told them we weren’t authorising them to do this on our behalf, but I suspect ECP/DRP will return to Leasing company when they get no joy with us. Does the car being on lease affect the normal response we take (ie ignore)? Is there anything further we should be doing? Thank you.

Not at all, the keeper cannot be held liable in Scotland because Schedule 4 of the Protection of Freedoms Act does not apply. Make sure that your lease company are aware of this and they must not pay it as there is no keeper liability in Scotland. Indeed forbid them to pay the invoice.
