    My boss squashed me into a ditch with a mini digger causing spinal injuries and a year off work with £0 !!!
    He has no employer insurance or public liability!!! Wot are they chances of making a successful claim?

    Establishing liability should be straightforward, collecting on it less so. But there may be ways of obtaining payment - you need to consult a specialist solicitor.

    Please note that any court action MUST BE STARTED within 3 years of the date of the event that caused the injury.

    Has your boss been investigated by the Health and Safety Executive?

      He's never been investigated by anyone ! I had jf law try but because he completely stone walled them and he didn't show up in insurance search also not in company house they said they couldn't do anything else !

        Were you working for him as an employee, with an employment contract?

        Do you have an address for him?

        It sounds like he was operating as a sole trader and hadn't set up a Limited company.

        I agree with ULA. From a legal.point of view you should be able to sue for compensation but he sounds like someone who will take every opportunity to avoid paying you. First you have to find him so that the court can serve papers on him. Then you will have to get the money out of him.

        You will need medical evidence of your injuries.

          He employed me for 7years , so I know pretty much everything about him ! I've got mri scans ,ipass spine people trying to sort my spine , I got orthopaedic trauma and fracture clinic looking at my neck and shoulder so I got a lot of medical evidence aswell .
          he owns his house ,ha vw work van , a vw people carrier he bought land in Thailand!!!
          Thinking about it I've never had a payslip and been waiting 3years for paperwork about my pension !!! If he has payed anything !!!
