  • How to proceed?

A family member walked into a lift in a hospital which had previously been identified as broken but not barricade or signed in any way.
The lift had it's doors open but was sitting approx 6 inches lower than the doors. My family member who is disabled, unsteady on their feet and walks with a stick, did not notice the low floor and fell and hit their face on the floor. Was taken to A&E and had a face x-rayed due to swelling and bruising. It was mentioned that been reported as broken but hadn't been fixed at the time.

Not sure how to proceed and what to do next. Also, what level of compensation do you think it's acceptable? Thank you.

    Hi
    Welcome to LB

The hospital is responsible for ensuring the safety of all employees and visitors on their premises and may be guilty of negligence for not making sure the lift opening had strong safety barriers and warning signage
Negligence injury claims can be a lengthy process in court if an agreement to the claim is not reached quickly. Some claimants report the accident, obtain photos and initial medical reports, then wait to see how quickly the injury heals and if there are any long term complications

Regarding your relatives accident it is worth the family member consulting a lawyer that specialises in negligence injury claims and may offer their service on a no win no fee basis
