As a bit of background, I was involved in a car accident approximately 2.5 years ago. The third party and their insurer admitted liability and I have been pursuing a claim for neck and upper back injury via the OIC Portal, from where an initial medical report was arranged and recommended physio and an 18month prognosis period.
The 3rd party insurer then arranged physio, which had a small positive impact, however I was still suffering after the original prognosis period, and continue to suffer. So the insurer arranged a second medical which only took place late last year, the outcome of which was to have an MRI scan which took place in Nov 24. The results of which were shared with the medical consultant, who then issued an addendum report recommending 10 sessions of acupuncture, after which they suggest the injuries should settle "to a nuisance level". Those acupuncture sessions are in the process of being arranged by the insurer.
The insurer made an offer earlier this month, which by my reckoning is approximately at the lower end of the neck / back band according to JC 17th addition. I countered with a value at the top end of the band based on the ongoing suffering / pain / disturbed sleep and, to my mind, a prognosis period of just under 3 years by the time acupuncture is arranged and completed.
The insurer has rejected my counter-offer and suggested they couldn't better it, unless I engaged a legal representative to formally discuss with them.
My feeling is perhaps they are blocked on raising an offer unless they receive threat of court proceedings - does that sound like a fair assumption?
If so, what are my options - is this something I can do myself, and if so is there anywhere I can find a process for doing this, template letters etc? Or does it need to come from a solicitor?
Equally, I'm keen to have the offer they've sent reviewed to see if it is actually reasonable given the circumstances and medical reports - however speaking to a couple of PI law firms, they appear uninterested as they haven't handled the claim from the start. Are there any recommendations of someone / somewhere I could contact for this?
