Just got a settlement offer, debating on whether or not to take advice of lawyer.

  • Just got a settlement offer, debating on whether or not to take advice of lawyer.

    Last September I was struck by a left turning vehicle driven by a 94 year old man while crossing a crosswalk.

    I suffered a head laceration, concussion, broken rib, torn abdomonal wall, bone bruise on my femur, and stretched MCL.

    I hired a local lawyer who is on the national trail lawyers 100 best list.

    He called me about 3 hours ago and said the insurance company has finally agreed to settle.

    They offered $36 plus thousand dollars. He also says he doesn't see me getting much more than what they offered if he does file a lawsuit due to my being in a forensic hospital after being found not guilty by reason of insanity and also not having long lasting injuries.

    I'm leaning towards taking the offer after talking with him but Im curious as to what the worst case scenario is if I take it to court. The older man who hit me was rather nasty to me after the accident.

    He got out of his car, stood over me and told me I wasn't allowed to walk in front of his car before walking away.

    Id like to see him hit with punitive damages in court but I don't want to risk a settlement. He hired a lawyer for his traffic ticket and got off on the charge after the bailiff refused me entry into the court room to testify. His being found not guilty criminally and my lawyer suggesting that I should accept the offer has me doubting my chances in court.

      I realized after reading some of the threads on here that this is a UK based website. Too bad expertlaw seems to have gone under. After talking with family I'll just take the settlement.
