  • Do I have a good case?

    i'm a 61 yr old male who 5 years ago had a 'total shoulder' replacement surgery. Surgery went fine, and I was pain free for 5 years until recently. I started experiencing bad pain again in my shoulder area and went back to the surgeon who performed original surgery. Surgeon sent me for CT scan that has reveled the 'stem' portion on the implant that is in my humorous bone, has apparently come loose. I am told the surgery must be done AGAIN. So I am unsure if..........
    1.) Do I have a valid case against doctor or manufacturer of device ?
    2.) Should I allow same surgeon to perform 2nd 'redo'surgery ?

    There is no way anyone can advise if you have a good case for a medical negligence case without having an independent specialist medical report on your
    condition.
    There are strict time limits for medical negligence claims in the UK. They are subject to a three year time limit which starts from the date of negligence or from the date you knew
    The other point to bear in mind is that it is exceedingly difficult to prove clinical negligence.

      It's probably not negligent, the bone is a living thing and could have changed dimension thereby making the insert loose
