  • Advice on no win no fee personal injury claim outcome

    In July 2018 l was involved in a car incident as a passenger.
    l just received the following documents for the outcome and wondered what everyone thinks with regards to the deductions. let me know if the screenshots are not visible. Any advice is greatly appreciated

    a ‘success fee’, which can be up to 100% of your lawyer's costs, however in personal injury cases, this is limited to 25% of the damages awarded (excluding any damages for future care and loss)
    You will be responsible for paying your success fee. It is therefore imperative that your solicitor clearly sets out in the CFA exactly what their fee (if the personal injury case is successful) will be.

      Hi Private - My initial thoughts are that you have had too much deducted. First thing you need to do is ask for your initial agreements. Be polite about it as this request has had previous solicitors heading up to the Court of Appeal for disclosure. I can see right away that the success fee is too high. This should only be 15% and NOT 100%. Solicitors are generally good at personal Injury but clueless when it comes to costs law. The risk assessment for a passenger in a road traffic case should be 15% and no more. The ATE premium is no longer regarded as a disbursement and therefore cannot be challenged for its reasonableness. To be hones - it looks a reasonable premium. So - try and get hold of your initial agreement AND before I get - KEEP HOLD OF THAT STATUTE BILL. My gut feeling is that they have overcharged you by £400.00
