• BMW S99(2) mileage claim

Hi, R0b

Thanks for your fantastic templates for VT and mileage claims.

I have VTd a BMW and they are claiming around £3000 for excess miles. My credit record already shows that they have closed the agreement and marked it as VT.

In response to sending the mileage template letter I received a notification of a complaint on Friday and then on Saturday I got their response to the complaint(!) They have decided that the mileage invoice is still due.

Do I need to do anything at this stage, or do I just wait and see if they take me to county court?

Thanks,
Neil

Hello,

Seems like you are at a stalemate so nothing to do unless they decide to pursue it by taking you to court. I can't say whether they will or not so you need to be in a position to decide if they step things up if you would rather settle the matter or defend it.

Just keep an eye on your credit file now and again just in case they change things.

Hi Rob,

I've just received a notice of arrears dated 12.10.17 of just over £3k. Will this go on my credit rating to force me to pay it without them needing to go to court?

I have taken a screen shot of my credit rating showing the account settled as at 30.9.17.

BMW are known for putting adverse entries on your credit file, either report it to the ICO or take them to court for breach of data protection. Many people won't do the latter and BMW know that so is just a way to put pressure on you to pay up which is what most people do anyway. Whether you follow suit is entirely your choice.

Hi @R0b,

Is there anything I can do first? I'm just not that keen on my credit rating being damaged for 6 or more months whilst I get it sorted?

Thanks, Neil

Hi Neil, I'm afraid not, as far as I can think of.

See this thread about s.42 assessment
