  • Voluntary termination of HP agreement

    I had a HP agreement with Peugeot for my car, and last month wrote to voluntarily end the contract. I used a template letter from Legal Beagles quoting section 99 of the CCA. The agreement was for 36 months and I cancelled it with 2 months remaining so clearly had made more than the required 50% in terms of payment.

    Peugeot have collected the car and have now written to me asking me to pay £256.78 for excess mileage and another £120.00 for scuffs to the alloy wheels. With regards to the excess mileage the agreement was for 30k (10k each year) and I was 1461 in excess of the limit. They however have pro rata'd the mileage and are asking me to pay for excess mileage of 3082 miles!

    As I have terminated the contract voluntarily, do I have to pay the above fees? The car wasn't brand new when I got it so I am convinced the scuffs on the wheels would be in line with usual wear and tear - although I'm no expert!

    Is there a template letter I can respond with to challenge Peugeot? Any help would be appreciated!
