• Ending PCP early

Hi,
I have read (most of) the post on here regarding ending a lease early and send a copy of your template to my finance company last week. Please bear with me while I explain my situation.
I took a car on PCP in March 2014. The agreement was for 48 months and I paid a hefty (3,500) deposit. I've never missed a payment and the car is in excellent condition (although I'm 2000 over my agreed mileage).
Unfortunately, at the end of last year, my son had to have serious neurosurgery which has left him as a full time wheelchair user, subsequently I've had to give up my job to care for him so my income has dropped significantly.
I wrote to the finance company asking to terminate my contract early, I wasn't expecting them to be pleased about it but having read lots of information, I was under the impression that eventually all would be fine. Oh how wrong I was. The company phoned me this evening to tell me that if I ended my contract now then I would still owe almost £1000! I'm not sure how, having paid 27 months worth of payments and the huge deposit. The options they gave me, even after explaining that they'd likely end up repossessing the car, were to give it back and then pay off my debt in instalments over 9 months or sell the car myself and pay off the settlement price. I'm doubtful, from looking on Autotrader, that I'll get enough to pay off the settlement.
Where do I stand here? I was so confident that I'd done everything correctly but clearly I've gone wrong somewhere along the line. I'm in a real pickle as my wheelchair accessible vehicle is arriving next week. I would appreciate any advice that anyone can give me.

Many Thanks

Re: Ending PCP early

Just to add, I've done some sums and I've worked out how much I would have paid by the end of the agreement and I have indeed paid more than 50% of that. I believe that they've calculated the amount to include the optional payment at the end. My annual statement states that my amount of credit was £13,740.00 and I have currently paid £9225.82. The statement however also has an 'opening outstanding balance' figure of £19,945.68 which I assume is the total value of the car and includes the final optional payment. I have taken a photo (without including any identifying details) but I don't seem to have the option to add one to the post.

A PCP is equivalent to a hire purchase and I would query how (with a detailed breakdown and reasons) as to why they have concluded if you terminate then you owe £1,000. Sounds like scare tactics to me, do you have a copy of your agreement by any chance? There would be a clause which says you can terminate early provided you pay X. I assume your referring to the agreement on your calculations.

If you click on the "Go advanced" button there will be a paperclip icon and you can upload your photo that way. Alternatively you could go to here http://postimage.org/ and upload it or send an email to Kati@legalbeagles.info

Just to confirm have they put anything in writing yet to state that you owe £1,000? If you have the whole agreement you could upload that would be great so I can see all the provisions.
If you have a question about the voluntary termination process, please read this guide first, as it should have all the answers you need. Please do not hijack another person's thread as I will not respond to you

I couldn't convert the PDF to word and it would be too lengthy to try and photograph the entire thing so I've sent it via email.

Thanks so much for your help.

Hi Carrie, Kati hasn't posted the PDF up on here yet so I don't know, I'll give her a nudge though Kati.

I doubled checked and the email address is correct but I've managed to work out how to upload photos so I'll try and do it that way. Unfortunately it's quite lengthy.

Re: Ending PCP early

its a Hire Purchase agreement, so you are fine you can terminate the agreement and be limited to 50% of the payment of the total price.

Page 2 of the HP agreement in the box talks about "TERMINATION: YOUR RIGHTS" you need to pay or have paid £9,972.84 to terminate however I don't think it has taken into account your deposit.

In my mind the total amount payable under the agreement is less any deposit/cash advancement. Renault don't appear to have taken into acocunt the deposit which means that your total amount payable should be 16,695.68, which 50% of that is £8,347.84 should be the half way mark.

I would be writing to them and querying why the total amount payable is £19,945.68 when a deposit has been made, that will be the starting point anyway.

Hope that makes sense.
