    Well the letter was sent on the 29th June and i had acknowledgement via post a couple days later (2nd July) to say they had received it and was being dealt with. Despite giving them until 4pm on the 8th July to reply to me and remove the default, I have heard nothing since. I have given them a couple extra days grace this week to respond but they have left me with no other choice really, I am going to have to progress to legal action as I promised!

    R0b you have been so much help to me, so thank you so much. Which course of action would you recommend here. I was planning on applying via the small claims court but I am not sure if that is the correct course of action.

      Hi Stoke,

      I probably wont be able to look at this in detail until the weekend at least, but in the meantime you could give them an extra bit of time, until Friday? Drop another email to the, mark it as urgent and briefly explain that a letter sent on 29 June, acknowledged by Santander on X date, the deadline has passed. You are now willing to give them until Friday and if the default is not removed by 4pm then it is your intention to issue proceedings without further notice.

      Hopefully they shall remove it by that point. If not and you still wish to pursue it then we can look it over at the weekend. Small claims will be the relevant track and you can submit your claim through MCOL, as the sums claimed are likely to be less than £300, then your initial issue fee will be £25 and then another £25 for the hearing fee if it goes to trial so your total cost is likely to be in the region of £50.

          Well, I didn't receive a response to the extended deadline, and my latest credit report published today still shows the default in place, so I am ready for further action against Santander since they are not being responsive. Any help you could give R0b would be fantastic.

            HI,

            God bit of news, Santander has called me to say the £70 fee was actually written off in June, and they have removed the default and put me back to being in good condition from March 2016 when the finance ended, so alls well that ends well! Will need to just keep an eye on the credit file to make sure that updates ok. Getting it all confirmed in a letter too

              Good to hear, apologies I did not get back any sooner, I was in the process of getting things prepared but looks like we do not need to go any further. I was actually surprised when they put a default on your credit file for the £70 as they did write off mine but even if it was written off in June they should have removed the default at the same time. Annoying that it takes the threat of legal action for them to actually change things.

              Does your credit file show the default still? Santander can remove that default within 24 hours or there is the normal option which gets updated at the end of the month. I would be pushing for removal asap as it has already been there longer than is necessary and you should not have to wait until the end of the month to have it updated.

                Nothing to apologise for, everything you have sorted for me has been top class and everyone has their own lives to lead Yes its a shame it took the letter to sort things out, but persistence seemed to be the key here

                The credit file service i used only updates once a month, and it only updated 3 days ago or ago, is there a way of telling sooner if the default has gone?

                  They normally update once a month but I believe it can be updated sooner then Santander updates it from their end. I asked them to remove it asap as the fact you have to wait another month (2months in your case?) should amount to some kind of compensation. They called me and said they updated from their end and that it should take 24-48 hours to update. It was done in less than 24 hours, so I think it is possible to do.
