  • car was sold to me as is ..

    i was told by dealer i could purchased warranty for 500 pounds or save by not buying it.
    the deal then became a sold aziz. which i foolishly agreed to and signed a receipt which stated so.
    two weeks after the car failed a full garage service which cost me 250 pounds.
    They advised to take to a specified specialist engineers for a block test.
    due to oxygen starvation to engine.

    on testing they found serious problem which has cost me 1350 pounds to fix.

    I still feel the garage should have had some responsibility towards contributing towards the cost of repair ,say,half the bill.

    Please advise if i have any reproach to the dealer,who in effect sold a car NOT FIT FOR PURPOSE. not to mention this car could have been an illegal unsafe car to have offered to the public.
    maybe the OFFICE OF FAIR TRADING could assist me in recovering some of the cost of repair.
    Any advice on my position would be gratefully accepted

    It is an offence under Consumer protection from unfair trading regulations (2008) (misleading actions Regulation 5)
    to mislead consumers about their statutory rights.
    To use phrases such as "sold as seen", "trade sale only" and the like is misleading.

    Your rights under SOGA remain in tact and the dealer is in for an education.

    Was the car in fact "dangerous", ie liable to cause injury to user or third parties.
    If so, there is also an offence under the Road traffic Act.

    I suggest first up a return to dealer, and if he doesn't play ball there is Trading Standards followed if necessary court action.
    Court claim should not be threatened unless you intend to carry through, and only used as a last resort
