    Where we live is on an unadopted/private road, the local council will not maintain it because of this.
    There is also a large proportion of second or holiday homes.
    One of these has a "buggy" type contraption, open cab, two seats with a "cage" around it, it has large wheels as well.
    Every time they come down (most weekends) they use this for getting about as said before until you get to the top of our bit of road when it gets to a public car park where our local lifeboat is. I know he goes onto the beach and I know this may be illegal but is he "allowed" to use it on the stretch of road that leads to this? (The road by the way is just a track really and has lots of potholes!)

        Just asked my beloved and he says.....
        If it's being used on private land then No,,it doesn't need either.
        It only has to be if it is used on a highway (non private road)
        BUT.....he says your best bet is ringing the Highways Dept at your local council cos the rules may be different due to your location (near beach)

            Beach locations often have local byelaws prohibiting this. It may be a matter worth reporting to your councillor.

              If this vehicle is unlicensed and untaxed, then how does it get to the top of your unadopted road, DT ? On a trailer ? I'm pretty sure that it should be taxed if not. I do believe that farmers who occasionally have to drive their tractors on public roads still have to register their vehicles and pay a form of Road Tax for that usage.

              But a more serious aspect of this is insurance, I believe. Even if a vehicle is not being driven on public roads, it may still need to be insured. An example of this may be where some years ago the son of the owner of a caravan park we stayed at decided that he could drive his Dad's car round the park because it was on private land. He had no licence, and therefore no insurance. If he had managed to wreck a couple of privately-owned caravans, and/or injure a couple of park tenants - he would have been in deep do-do, I believe. Third-party insurance is still a legal requirement where a vehicle is being used on land to which any third party has lawful access, as I understand it.

              An unadopted road is such a piece of land - and although Road Tax may not be payable - I believe insurance is still required. And driving without insurance is a more serious offence than no Road Tax.

                  Thank you, will print out later.
                  We are, according to documents we have, responsable for the road out side the house.
                  Also the council ,up to last year, always said it was "private" but that changed to "unadoped" when English Nature wanted to include it in the "Coastal Path" and part of the road would have to be used at high tides.
                  But its not just him, there is a speed limit, due to the nature of the road it would be difficult to do more than ten mph any way, that does not stop delivary vans speeding or quad bikes/ trial bikes using it, and the beach, as a race track!
                  By the time you have phoned non emergancy they have long gone.

                    Whatever you might do, do not break an egg or two into the buggy's fuel tank, as that would cause an intermittent fault that would be tricky and time-consuming to diagnose. Likewise, one should not pour beach sand into the vehicle's oil filler, as that could seriously impair its performance.

                        They're great for leaking radiators just to get you home though. I popped half a dozen in a van I used to own a couple of times - worked a treat!

                            I dont know the legalities here?
                            If its a private/unadopted road there is probably no legal speed limit the house deed should show who has right of way along the road and the insurance tax situation should be directed to the police its theywho take action if the law is broken maybe the road is on common land and different rules/laws may apply as for all the suggestions regarding eggs etc lighthearted they may be but those actions could result in criminal charges.Maybe some legal advice from a specialist solicitor would be best advised

                              I suggest videoing it and sending that to the police as evidence, with a nice letter saying as you can't catch em, I have!!

                              I would also be tempted to see if there was a way of restricting his access, say a gate one end of the road that residents and the Fire Services have the key to
