    Hi , About 8 weeks ago I bought a motorcycle in a private sale on E bay. I paid by BACS transfer when the chap delivered the bike . the bike was a 2002 Honda 650 . The listing showed it in great condition and a few minor age related marks.
    Due to an on going back injury I could not ride the bike after a couple of weeks and I have sold it on Ebay. The guy wanted to see it first , I gave him a time , he didnt turn up but came next day to buy the bike. He had a look over it , we did the paperwork , gave him a reciept , sold as seen . He has now contacted me 6 days later to give me a long list of faults would not ride in straight line and has evidence of a front end collision , imbalence on wheel , corrosion on swing arm , tyres near limit , brake pads low and then said he did an HPI check and its Cat C from 2006 . I did not HPI check the bike when I bought it and having spoken to the guy I bought it from , He bought it in 2009 and was not aware either. This guy has today rang my phone 6 times , sent me 5 emails , demanding a full refund , costs of fuel.. even though i gave him a full tank , and additional costs he has incurred and is threatenig me with solicitors , ebay legal etc .Ok I accept the Cat C is nobodies fault , we should have checked before buying , but to contact me 6days later with all these issues and threats , How do i know he hasnt come off it ofr damaged it.
    Any ideas on what I should do ?

    First thing I would do is check your position with ebay. It appears you have acted in good faith, if there is no breach of their rules then everything should be sweet.

    Mind you I am no expert in this area.

      A Category C write-off has to be thoroughly-checked to ensure it is safe to go back on the road after being repaired. The first thing to do is check its MOT history via the facility on the DirectGov website. If there are any issues with the bike's MOT history, contact the Vehicle Operators & Services Agency (VOSA), part of the DfT, who are responsible for overseeing the MOT system, for advice.

      Also, speaking as a retired policeman, I would advise you that it is not wise to sell a vehicle on a Sold As Seen basis. It is very easy to fall foul of the Motor Vehicle (Construction & Use) Regulations which contains a specific offence of selling a motor vehicle in a dangerous and/or defective or unroadworthy condition. Offences under the regulations are absolute offences, which means that there is no defence, only mitigation.

      In your case, you did not know about the Category C write-off. It would appear, therefore, you are as much a victim of someone else's dishonesty as the person who is now giving you grief. Don't be bullied.
