  • Private Clamping Companies

    I've been told that as of the 1st of October 2012 wheel clamping by private companies will become ILLEGAL (The police and other government agencies will still be able to wheel clamp under certain conditions)

    BUT From 1st October owners of cars wrongfully parked on private land will be legally required to provide details of who was driving,

    And the DVLA are legally obliged to sell individuals’ vehicle licence information to private parking operators so that they can chase unpaid tickets,

    If you do get a ticket on private land and think it is unfair there is from 1st October an independent appeals service that will be available to those wishing to contest tickets from parking on private land.

    Is there any truth in this??

    Yes and yes, but so.
    The ban on clamping on private land is the best.
    The requirement to name the driver has always been there.

    The end of the day PPC's have very little legal powers to levy charges for parking on private land.
    The only time that it is enforceable is if the area has a physical barrier, otherwise they can whistle.

    As ever pay council and police tickets as you get them.
    (yes I recognise the old adage of Signs and Lines, but this is a rule of thumb)

      I have looked at the Protection of Freedoms Act with regard to the issue of PPCs enforcing "parking charge notices" on private land. From what I can see, Parliament has put quite few obstacles in their way which they must overcome before they can legitimately pursue a motorist for payment. However, it will be interesting to see how long this provision lasts before it is repealed and PPCs go back to receiving "Go swivel" letters from motorists or a "Go swivel" message from Parliament consigning it to the dustbin of history, along with clamping on private land.

        I see no difference between getting a 'ticket' on private land, than I do on Private Parking Companies trying it on.

        Its speculative invoicing, there is still no requirement in law to pay.

          I think that's why Parliament has put a lot of obstacles in the way of PPCs. The onus is on the PPCs to comply and prove they have complied. However, I am of the opinion the provision will be repealed and ticketing of vehicles on private land outlawed like clamping on private land. If that happens, I'll miss Nobby the Gnome at my local Morrisons.
