Bought a use car from a dealership, not main dealer. before collection I reminded him twice that we live over 70 miles away and to make sure aircon, electric doors, mirrors etc all worked as bringing it back wasnt viable in terms of time, fuel and car hire costs.. He assured me they were all working fine. collection day was a cold day so wouldnt have known if it was air con or cold air.
Guess what....2 days later, sun came out, air con not working!
Trading standards say i can claim consequential losses involved in returning the car to dealer which will be around £200 including car hire. He insists he doesnt have to pay them but will fix it if i take it back. He will not pay for it to be repaire locally to me either to save me that expense..The point is, he sold it to me faulty, its not something that went wrong a few months later.
Can someone please tell me if i take this to small claims am I likely to win the consequential losses or not?
