  • Potential Warranty claim

    Hi,

Im looking for some guidance on possible next steps in regards to a warranty claim I may or may not have.

I bought a used car in May 25 from a main dealer, the car was two years old (23 plate).

I signed up to the manufacturers website and all singing and dancing app

looking around the website I saw I was entitled to a free map update to the latest version.

I verified my car, inputted various details in relation to the current map I had and was given access to the download.

I printed out the instructions and followed them to the letter.

on putting the usb into the car the update was recognised and I had to enter a code to proceed, I did so and the update started.

The update subsequently failed with an error message, including. Please contact dealer

    I did just that.

They took it in and couldn't fix the issue and have contacted the Car manufacturer for further guidance.

early indications are that they are trying to blame me for not following the procedure correctly.

I looked around relevant forums to see a similar case with the same car and the exact same error message.

his car was newer but the dealer/car manufacturer allowed the claim under warranty.

    My questions are this,

If I am denied a warranty claim, could the case in which one was offered be used to establish a precedent or possible fault
    or
Would I be better going down the consumer rights act route and trying to establish an existing fault at the time of buying the car..

Any advice would be most appreciated.

    Hi Andy
    Welcome to LB

I know very little about vehicle inbuilt sat navs and map updates
There is an article "How To Update A Built In Car Sat Nav" at www.yourcar.co.uk

With the continuous construction of new roads, junctions etc it is important to regularly update maps on sat navs

You followed the manufacturer's instruction but although the update started with your car, it failed.

You took the car back to the dealer and he was unable to fix the fault and update the maps

You bought the car less than 6 months ago, you have given the dealer a chance to repair and he has failed.

Under CRA you are now entitled to get the fault repaired elsewhere (assuming you like the car and want to keep it) and claim the cost of the repair (damages) from the dealer

If you can obtain a quote in writing for the repair, you could consider updating the head unit as in the article. You will have to pay the additional cost, you can only claim the cost of repair from the dealer

      Thank you for the reply,

      a couple of points.
the dealership may well be trying to blame me for the fault.
does any similar case which was settled under warranty create a precedent and help show there is a fault
      thank you

You could try searching using the word "warranties" under "Case Studies" on the motor ombudsman website
Although their decisions do not set any precedence there might be a few cases that may help you decide what to do
