  • Options after 6 months

I bought a brand new car back in March 2024, after 7 months it developed a fault that brought up a message about a charger fault and to stop the car. I had to wait 3 weeks ylto get the car into the garage and was then without the car for a further 2 weeks, all with no courtesy car. I picked the car up and after 5 days it failed with tje same fault message and 4 new ones. This time the car was in tje garage for nearly 3 months, although I was given a courtesy car after a couple of weeks. Two and a half weeks after I picked the car up it failed again with tje same 5 messages and I lost all drive while on the motorway. As the fault keeps reoccurring and they have had 2 attempts to repair what are my options to reject, I am aware about having to prove the fault was there before the 6 months is on me but if they can't find the fault how can I do that? Do I have a case for a full refund and rejection?

    Hi
    Welcome to LB
You are correct, to reject the car after 6 months under CRA 2015 the consumer has to show that, on the balance of probabilities, the serious fault existed at the time of purchase/delivery
I wouldn't have any confidence in the garage that you are returning the car to
You should take the car to a qualified auto electrician to obtain an independent report
If you end up making a claim you can add the cost of this report along with any other loss and expense you have incurred

Assuming the specialist believes the fault existed at the time of delivery, you can write to the dealer rejecting the car and giving notice that you will also be claiming your loss and expense

The dealer is entitled, under CRA, to make a deduction on the refund for usage, normally based on miles driven with the car

How did you pay for the car?
Did you use a credit card for the deposit?
