  • VW Finance - Failed Credit Check - Refund Issues

    Around 6 weeks ago I went into a VW Garage to enquire about PCP for a new T-Roc match. A day or so later I received a call from the Garage to say that a car that met my specification was available, and would I like to go in to look at it and complete a finance proposal. I paid £100 to secure the car over the phone, and went in the following day. I completed the finance proposal, which I signed, and was told they'd be in touch once all the checks were complete.

    Unfortunately, I failed the credit check and was informed that things couldn't proceed further at this stage.

    I asked the representative to refund my deposit which she agreed and I was informed that it would go back on my card. I followed up with an email referencing our discussion and asking for the refund to be completed etc. I also re-read the terms of the proposal, and there is a section regarding cancellation, which I'm doubting applies in this case reads as follows:

    "6. Cancellation. Except as provided for in these T&Cs, no order which has been accepted by the seller may be cancelled by the purchaser except with the agreement in writing of the seller and on terms that the purchaser's deposit shall be forfeit and further that the purchaser shall indemnify the seller in full against all loss (including loss of profit), costs (including the cost of all labours and materials used), damages, charges, and expenses incurred by the seller as a result of cancellation."

    That was nearly a month ago. Despite chasing, I don't seem to be getting anywhere. I've considered raising a dispute through my bank.

    Any advice would be much appreciated.

    You should be refunded your deposit. The seller would not have placed an order for the car until the credit check had been carried out. It is the dealer and finance company that are refusing to continue with the PCP
    Write a letter of complaint to the dealer stating what has happened and you will take your complaint further if your deposit is not refunded on your card within a few days
