  • There is a signed statement of truth within form N244 - I just do that and not duplicated in the WS?

    Yes I intend to append all the documents I refer to (and to source them)

    • Your witness statement should be a separate document. Tick the box in Q10 on the form. Make sure to provide claim and court info on the front page.
      Your WS should refer to documents listed and referenced in the Evidence box under Q10.

      You could put the Alternative Order under its own heading.

      • Don't forget if there is more than 50 single sides of A4 you will need to file a hard copy with the court by 4pm on the 25th

            The WS isn't simply Question 10? The main WS is due by 22nd July.

              • You need a sameday courier.

                Your witness statement for your application can be a mini version of the main witness statement

                When a party objects to the application they normally file and serve a witness statement opposing the application

                • Unfortunately you can't. CPR states only one email for each stage in the process.
                  You should have been given more than 1 day to make
                  an application. It does seem it was done deliberately to put you at a disadvantage.

                  • The way I work, it's entirely possible I'm not home at all during the week. It seems an impossible deadline unless I take a day (or two) off work!

                    • Can I avoid attaching the documents I am referring to? Especially the report without which it may be under 50 pages.

                      Or can I send the hard copy attachments now and then refer to them in an email N244?

                        I haven't given any thought to a witness statement yet. Honestly, I've just been focusing on what is next.

                          It's not even possible to send it Royal Mail in that timeline! I literally have to go to the court myself (or employ myself to go to the court - lol)

                          • Are you able to post a hard copy by Royal Mail 24 hour tracked say on Tuesday
                            My advice is not to separate application documents I wouldn't trust the court to collate the emailed form with the paper documents.
                            An organisation that takes 4 months to reply to an email with a yes or no answer

                            • Honestly, I'm a bit frustrated and I've run out of time (need to go to bed - I'm off to work at 7am in the morning). Looks like I'll have to take Thursday off to deal with it. I presume I can deliver to the court in person.

                              • Ok, my current thought process is, if I can get everything prepared in time, to send it today with the explanation that it is impossible to meet the 4pm Thursday deadline sending any later. I can explain that there has been zero contact or response from the defendants and even if they contact me in the remaining 3 days, that leaves insufficient time for an agreement to be reached. They have not made any attempt in the 88 days since the court order.
