If your partner does a lot of short journeys to carry out her job, a diesel car may not be suitable. Car manufacturers recommend a diesel car is taken on a 20-30 minute drive over 40 mph at least once a month so the engine and exhaust heats up sufficiently to burn off excessive soot.
If the fuel tank is under one quarter full, active regeneration of the dpf may not take place..

We have a new update for you guys, with the evidence from our Mazda dealer providing the statement of events, the finance company has been in touch and has told us that they are going to let us reject the vehicle and unwind the finance, what a relief it is to myself and my partner, I really didn't think they were going to let us refuse the car, and without that statement from SG Petch we probably would have been in court dragging it out for months, wow, thanks once again to you all who have read and assisted with your advice and support, it has been a real eye-opener and lesson to us both and in future make sure we have written evidence from all turn of events and factual proof if any issues arise. It will take a little more time to get everything back to the way it was but at least we now have a final answer, take care and keep up the great work!

            Great news.
Just be aware the dealer might try to deduct money from the refund for use of the car (depreciation). I thought I read a dealer is entitled to do this after 30 days.
You would have to argue against this - loss of earnings etc

If you exercise your final right to reject the dealer can make a deduction for use.
They generally try for 45p per mile as that is taxman's figure. However the true figure should be somewhat less than 15p per mile.

If you have exercised your short term right to reject no deduction for use can be made.
Whether or not you have exercised your short term right is difficult to see from your posts
The short term right applies to the first thirty days after delivery, but takes into account any time the vehicle was with the trader for it to be returned to a satisfactory condition.
The clock stops when the vehicle is delivered to the trader, and only restarts when the vehicle is returned in a satisfactory condition to the customer.
It seems that the unsatisfactory condition was notified to the trader three days after delivery, and that it was never returned in a satisfactory condition.

You may also claim for costs arising directly from this matter
