  • Excessive damage charges

    I sent my Voluntary termination letter on Wednesday 19th May and this was accepted. I had my car collected on Tuesday 25th May and inspected upon collection.

    The man quoted me 420 damages for stupid little scuffs, scratches and a dent which was less than 2cm. Albeit they noted my car in average condition both inside and out. The man told me to refuse to sign for the damages (which I was going to anyway) and said that it was in brilliant condition compared to some of the cars he collected, one of the best actually.

    Today I received a letter from my finance company Moneyway saying those charges have been added to my account's outstanding balance. I was hoping they would have cleared the charges as they were ridiculous.

    I used the template letter about excessive damage and have sent this today stating also that I've paid more than 50% about 500 pounds more and that this covers the damages and that I also deny liability for the damages and the onus is on them to prove they were first down to me and second that they are beyond excessive wear and tear.

    Nervous now about whether they will wipe the charges as I refuse to pay them. The car is 8 years old and has 66k miles on its clock. Its obviously gonna have a few light scratches and scuffs on it.

    Update-

    So they requested the money and I refused to pay stating that it was up to them to prove the damage was caused by myself. I'm now waiting on them getting back to me on this which can apparently take up to 8 weeks.

    Today my credit score dropped as a result of a 'missed payment'. Can they do this while I have a complaint in process over the charges?

      So they phoned me today and said it is on me to prove the damages were there when I got it. Is this correct or not? R0b

        Who is the finance company?

        Are you able to upload a screenshot of the account history from your credit report? I'm curious whether they have recorded the account as closed or voluntary terminated.

          Its with moneyway. It hasn't updated completely on my credit file but I got an email from clearscore etc to tell me to expect it to come up as an account in arrears.

              This is my inspection report. The 100 pound dent is literally a pin prick size dent and it was there when I got it. The damage to the bumper I would pay as I could have caused that but that amounts to 140 just and I refuse to pay 420. They offered me 10% off but I said no.
