    Hi there

    I VT'd a car with Renault - RCI Financial services ltd back in August 2018 and had £1,300 excess mileage charged to me (9,500 miles over agreed apportioned limit, although they were stating that the car had 2000 less miles on it that it actually did when i bought it, but i have no proof of this - dealership mistake)

    I downloaded your templates and sent two letters, the second i didn't get a response to so assumed the matter had been closed, but have this month (August 2020) had a letter from a solicitors firm offering me the chance to settle for half of the amount and threatening me with a CCJ if i don't pay.

    Am i still within my rights to deny this charge or is there any new case law that would go against me?

    I've drawn up a reply as follows, would really appreciate some guidance on this please, citizens advice were not very helpful at all.





    Further to your letter dated 5th August 2020 in regards to an alleged amount owing to RCI financial services Ltd, please see enclosed correspondence between your client and myself.

    As you will see from this letter exchange, the amount being pursued is for an excess mileage charge which I have argued is not recoverable. After my letter dated 7th September 2018, I received no response from RCI financial services limited and believed this matter was closed.

    My stance on this matter remains unchanged, as does case law regarding excess mileage charges and voluntary terminations.

    I have taken legal advice and believe that the lack of response from RCI financial services, recent case law and two-year delay in chasing this alleged debt would put me in a good position to argue this matter in court.

    I would invite you to close this matter, or if you believe that the amount is payable to give detailed reasons as to why.
