  • BMW Financial Services - Excess Mileage - Credit File issues

    Good evening,

I VT'd my Alphera PCP in May 2018. After following the advice on here, they raised an invoice for excess mileage and damage charges equating to c £960. I have disputed these using the templates on the site and they came back with a final decision that the charges were due. The issue has been referred to the Financial Ombudsman for them to review. The FO have been looking into the issue for 18 months and despite chasing constantly they keep just fobbing me off and saying they have loads of similar cases so can't advise when a decision will be taken.

In the meantime, my credit file with Experian has been destroyed. Alphera have not registered a default but my file just shows as being 6 months overdue each and every month. As a result, I am not able to raise credit for anything. This is having a major impact on my life now so I am considering whether I can take Alphera to court to force them to remove the charges from my account and correct my credit file to sort out my score. I am Scottish so is it possible to do this through our version of the small claims court?

Strangely, equifax have marked the supposed missing payments as Unclassified and my score with them appears to be fine. My issue is that the negative impact of Experian just trumps everything.

Any help would be hugely appreciated.

    Best regards

    Iain

    Hi Iain,

I have been in this exact position once before, and I also find myself in it again dealing with my partners account.
I was successful in the first instance by using BMW's escalations service and essentially detailing all their cock-ups such as breaching the Data Protection Act and ICO guidelines.

In response they issued a letter that stated they will drop the charges and clear the credit markers as a "goodwill gesture to restore my faith in BMW" - not an admission of guilt whatsoever! I'm more than happy to share the email thread with you if you private message me your email address.

    All the best,
    Jon

      Hi Jon,

Just seen this thread. I'm having a similar issue with BMW finance - albeit I reached the end of the agreement and then was late paying the excess mileage fee, w. Are you able to share with me the email thread you mention above as I have just escalated this within BMW finance.

      Many thanks Chris.
