  • VT - Liable for vehicle condition due to non collection?

    Hi All,

    Great forum and fantastic resources for keeping things correct.

    Used the concise guide and templates to VT our vehicle before lockdown started due to ill health and a decrease in our finances.

    The VT was started before the lockdown and reply confirming received day before lockdown began however collection could not be arranged which is understandable.

    However, it’s now over 28 days and no alternative arrangements are in place, offers of dropping the vehicle off to them are ignored and replies stating I am responsible for the vehicle condition and tax/insurance.

    I have had frequent contact with the finance company and receive misleading and threatening emails about liability charges for mileage and in particular, the threat of being charged damages from the time until collection.

    After fair notice, tax/insurance was cancelled, the v5 transfer declaration was completed

    May I ask advice on what the standpoint is with VTing the vehicle and being responsible for the vehicle condition after a fair and reasonable time has passed for it to be collected?

    I had contacted them on 28 days and informed them that I had cancelled tax/insurance and transferred the V5 to them as rightful owners after fair notice that I would do so? I recorded and photographed the vehicle condition/mileage etc to show as of that date, the vehicle was in fantastic condition but they have responded to say that it doesn’t matter, it only matters what it will be like when it’s inspected and collected.

      Vehicle*was collected today by BCA. *They had previously sent a long email about collection methods and safekeeping including the caveat that the driver would sign on my behalf.

      I stated in writing that I did not give permission for anyone to sign of my behalf

      It has transpired that VWFS had not passed the details to BCA before lockdown so collection could not have been arranged due to that error. *

      BCA procedure was simple but be wary of accepting things “on your behalf”. *I left the vehicle keys and paperwork with the car about 1/2 hour before the ETA the driver said, taking more photographs and video evidence

      Inspection report was sent by email with no photographs/evidence or driver signature. *Report stated multiple chips which genuinely utter nonsense and additional charges.

      Forwarded inspection report to VWFS and BCA immediately with evidence of no damage to door and stated that Inspection had taken place after car had been driven and moved etc.
