    Hi,

    Firstly what a great forum place this is and it's already proving a massive help.

    My daughter is returning her car and it has maybe half a dozen light scratches which i would say are reasonable fair wear and tear.

    In the letter template 'response to finance company disputing condition of vehicle' paragraph 3 'Notwithstanding.....' has me confused. If they do try and charge for the scratches then is this paragraph referring to an offer/compromise by my daughter for the charges? The paragraph states 'i have paid...' - paid what and to who?

    Thank you in advance for any guidelines on this part of the letter.

    That paragraph is an optional one. The intention behind it is to say that your main argument is that you believe the condition of the car to be reasonable, but even if they so happen to be right about the damage being excessive wear, then you have paid X amount of the total price which is over and above the 50% limited liability that you have, and that should offset the claim for vehicle damage.*

    Of course if you haven't paid over 50% or if you have and the sums don't exceed what's being claimed, then this paragraph doesn't serve a purpose.

      Many thanks for your prompt reply.

      When the car is returned she would have paid over 50% so it is that amount, for arguments sake £5000, that she would mention in that paragraph?

        The paragraph is worded to say how much you've paid in total so if 50% is £10k and you've paid £12.5k then youd put £12.5k in there.*

        If you want to reword it to say that you've paid 55% or X amount more than half the total price you are more than welcome the letter is just an example so it's not rigid.
