  • VWFS VT - threat of further action

    I VT'd my VW back in September and got an excess mileage charge letter from VWFS. I used Rob's template for challenging this and VW rejected my claim out of hand but said if I wasn't happy I could raise the matter with the Financial Ombudsman. I did this and advised VWFS of the FOS reference I received. Since then I have had 2 letters from debt recovery firm Themis Recoveries and now a letter from Blake Morgan LLP demanding payment and offering repayment plans. Doesn't this mean VWFS have breached FCA Handbook CONC 7.14 rules?I am holding my nerve at the moment and responding to Blake Morgan with pretty much the same initial response sent to VWFS disputing the excess mileage charge but am concerned about Blake Morgans statement in their letter about possible further action – “Unless we receive payment in full .... within 14 days of this letter, our client will take steps to recover the outstanding balance which may include court proceedings. If further action is taken, the balance owed by you may increase.” If they do instigate court proceedings what is the likelihood of them demanding even more than they claim is currently due.
