  • VT with VW Finance, MOT expiring before collection

    Hi,

    I know there are many similar questions, but as all cases are different, I hope I’m ok to ask my questions.

    I’ll try to keep it simple-
    23rd August- Emailed & Posted (1st class mail) notice of VT to VW Finance
    • 23-28th Augsut- Various back and forth emails of VWF using delay tactics (such as sending same emails twice, asking me to reverify details on numerous occasions etc).
    28th August- Reply on to reverify details.
    30th August, 3rd September and and 6th September - Emails on verifying details and continuing to confirm my intention to VT.

    • VW Finance say that notice of termination was issues on 6th September, when actually as above, was issued on 23rd August.

    10th September- I informed VWF that the chosen collector of the car couldn’t collect the car prior the the MOT expiring on 25th September and that I was giving them until 24th September to make prior arrangements for collection. Failing this, they would have to collect the car at their own cost with no MOT.

    They are no insisting that as the VT was only “issued” on 6th September (incorrect) that they operate a 4 week timeframe and it is my responsibility to MOT the car. They say if I don’t MOT the car, I will be charged £500 for a freeloader.

    What is my position here? Do I have a position to fight or should I cave?

      Their own internal timeframes are of no consequence to you, your VT was completed on the day they received your letter, a letter that they have acknowledged to have been received.
