  • Dealership used wrong amount as Settlement figure

    A dealership has used the final payment amount (£5124.00) of my PCP in error instead of the actual settlement amount (£8331.68). This then made my vehicle appear to be in positive equity from which the dealer then arranged a new car and finance deal for me.

    On the day I was due to collect the new vehicle, the dealer then requested me to get a settlement letter from the previous finance company. In the meantime, I signed over the old car to them and it was put into trade status, and I signed for the new car which was put into my name and drove away the same day.

    The dealer received the settlement letter the following day and this what they wrote in an email back to me;
    "I've just received the settlement letter from Barclays and it says your settlement figure is £8331.68. This means the car is actually around £2831.68 negative equity. This is a shock because from what I've seen the settlement was £5124, based on figures and documents you've provided, which is what we have based everything on. From here this then means that either you have to pay the difference,we have to put you back in your car and unwind the finance, or you have to pay 2 finance plans."

    To me this is negligence on the dealers part, but they have suggested I request voluntary termination on the old car or pay the negative equity for them to clear the old finance.

    Please could someone suggest the best way for me to proceed?
