  • Voluntary Termination worried about problem with car / Plus some opions needed!

    Hi,

Stumbled across this site while googling for info regarding VT. I have a loose bit of trim which has been like that since day 1 of owning the car. The car has been back to Peugeot 2 or 3 times to be sorted and for various reasons its never actually been sorted. I'm now worried that they may try and charge me for it as "damage". Ive tried to contact someone at Peugeot to see if they can take a look again but its proving tricky to get to speak to anyone!

I have found bit of paperwork that references the car being booked in to look at it, would that be enough to dispute any claim for that?

I have attached some pictures of the loose trim and also a scuff to a rear seat which has been caused by a baby seat (I think) I've also attached some pictures of that and I would like some opinions of whether that would be fair ware and tare or not?

Also Peugeot sent me some documents about returning the vehicle and to sign etc and also charge me £79 to collect. I plan on now sending them the template letter from this site. Am I still legally allowed to drive the vehicle once the letter has been sent or not?

    Thanks
    Wayne

Expect Peugeot to charge you for those photos you've uploaded. Obviously if you have evidence that the trim was an issue from day 1 then you have a defence to any of the charges they try to apply.

As for the seats, I expect them to charge you and mark it down as soiled so maybe £20-£25 per spot or if they're generous that might be the total amount. IF you are worried, give it a scrub yourself or get a full valet on it, or if you want to try save some money hire a carpet washer and do it yourself.

Legally, once you give notice and the agreement terminates, you have no right to use it because your rights are lost when the agreement ends. Can Peugeot take you to court for using their car? Strictly speaking, yes unless you get their permission to use it. Will they know you've used it? Probably not, unless you have already given them the mileage of the car at the time of you giving your notice and they compare the mileage you gave against the odometer - but the risk is entirely yours.

Thanks for your responses R0b, just to be clear its not a dirt etc on the seat its actually damage to the cloth itself. I clean the car every 2-4 weeks including the seats this isn't something that will clean out, would the charge likely be higher then the £20-£25?

Also they have said that I must keep up with monthly installments until the car has been returned but as I'm sending them a payment for the last £70 that is due to bring me to 50% paid is this true? I would of thought that as soon as the 50% is paid and VT letter has gone in then the agreement is finished at that point?

No I would suggest not to pay them. There is a risk they may mark your credit file as late payments if you don't but then you'll have a remedy for negligence and breach of data protection if you pursued this to court. Whether you want to go down that route is entirely up to you.
