  • VWFS and Financial Ombudsman

    rob

I am currently battling VT excess mileage charges and VWFS have sent the final letter stating that they reject my complaint and the money is due. I'm in the process if filing the complaint with the Financial Ombudsman but my question is what happens to the debt in the meantime? Can I ask VWFS to place the debt on hold so they don't continue to pursue it while it is being considered by the FO?

    Thanks
    Nick

I suppose the first place to look is the agreement that you signed.

Pursuing a debt is not the same as having bailiffs turn up at your door. In my experience, you have to have a Court judgment against you before anyone can force you to pay a debt that you dispute. So it doesn't matter if you ask for the debt to placed on hold, it remains a disputed debt until the Court or the FOS decide otherwise and no-one is going to turn up at your door in the meantime, unless of course you're dealing with the Russian mafia.

Without a Court judgment, any law abiding collection agents would just be wasting their time.
