  • Problem With Car Sales Canvassers

    I recently advertised one of my motorcycles for sale in Motor Cycle News. I started to get the usual calls from the canvassers who state they have buyers lined up, the ones who when you ask how many buyers there avoid answering the question and quickly change tack. However, I received an unsolicited call from a company called Motormarket UK. I suspected the usual BS but they specified they had 4 potential buyers in my area looking to buy my motorcycle. I took a look at their website and buoyed up by the idea of them having listed the specific number of buyers I agreed to sign up.

    I think you can guess the rest. This was a month ago and I have not received a single call from a buyer put on to me by them. I e-mailed them last week and asked for a refund which they have declined. They also stated that the cooling off period of 7 days didn't apply as they had started on my sale immediately. I didn't even mention a cooling off period in my e-mail.

    So, where do I stand? I have started a chargeback process with my credit card company on the basis of not receiving the service paid for. I have also contacted Consumer Direct.

    Any other advice would be most welcome.

    To follow up, I have written to the company and asked for a refund, citing the lack of punters contacting me as promised by them. They have given me 2 conflicting versions in 2 seperate letters.

    Version 1. Distance selling regs and 7 day cooling off doesn't apply as they started working on the sale immediately.

    Version 2. Distance regs don't apply as I have tried to cancel outside the 7 day cooling off period.

    I haven't been going for it on the regs but on misrepresentation, but the fact they have given conflicting info on the cooling off period is interesting.

      Sorry that you havent had any response to your questions here BBB. I`m afraid I myself do not have any advice to give you on this.

      Could you post up a copy of their T&C`s from the website?

      What have your credit card company had to say regarding your chargeback?

        Ok, a bit of an update on this. A few letters have been exchanged between myself and the company. They keep coming up with different versions of the distance selling regs.

        1. They don't apply as they started to market my bike straight away (allegedly).

        2. The 7 day cooling off period did apply but they won't refund as I asked for it back outside of that period.

        3. I was told on the phone by the sales person that they do not accept refunds or cancellations.

        The last statement (which is in their last letter to me) totally contradicts their assertions that they are fully compliant with the distance selling regs.

        I sent off a copy of all the letters to the credit card company a couple of days ago, so I will have to wait for them to respond.

        They have also refused to supply me with proof that they did have 4 buyers in my area wanting to buy my specific make and model motorcycle.

          I received a letter from the credit card company advising me that they have refunded the amount I paid for this "service":hohoho: I will have to wait and see if it will be challenged but that is a nice result for starters.

            Another update. I was contacted by York Trading Standards regarding this company and their activities and they asked me to provide a statement, which I have happily done. I wonder how far this one will go?
