I have read the guides and eveything has been helpful so far but not finding much info for the next step
breif summary
new clio bought from renualt (RCI) on PCP
we VT'd after half the total payments were made as due to a change in circumstances the car is no longer affordable
RCI send us a letter asking for £2300 in excess mileage charges
I complain quoteing sections of the comsumer credit act and that i believe the vehicle was mis sold (5,000PA on a diesel) but this gets nowhere so i ask to put in an offical complaint
I receive a letter saying they have reviewed the case and they do not believe the vehicle was mis sold (no mention of my point that excess mileage isnt due as the vehicle was VT), they never contacted me for any info during the review and now asking for the full amount again
Thats were i am at now and i see my options as the following
1. go to the financial ombudsman (i have read through pages of there previous decisions on this issue and all side with the finance company)
2. go straight to the small claims court (will this make a win less likey if i go to the ombudsman first and lose that?)
Should i drop the mis sold angle and just focus on the CCA sections?
Has anyone actually went as far as court on this issue and what was the outcome?
